The Constitutional Court has agreed to hear a fresh petition challenging the legitimacy of former President Edgar Lungu’s second term in office following his controversial election victory in 2016. The petition, filed by Nkulukusa Teddy Kalusa, also questions the legality of then Vice President Inonge Wina’s tenure during the same period.
Mr. Kalusa contends that Mr. Lungu and Ms. Wina were never formally sworn into office by either the Chief Justice or the Deputy Chief Justice, as required under Article 105(1) of the Constitution. This procedural oversight, according to Kalusa, undermines the legitimacy of their tenure.
The hearing is scheduled for January 2025, reigniting debates over the 2016 electoral process and its constitutional implications. As the date approaches, the nation watches closely, anticipating the potential impact of the court’s decision on Zambia’s political landscape.
