Road Traffic (Amendment) Act number 8 of 2022 was assented to on 9th August 2022 and is now in effect, the Act gives drivers an allowance on speed limit.
Section 27 of the Amendment Act 2022 amends section 148 of the Road Traffic Act of 2002 by inserting speed limit tolerance as follows;
a) 10 per cent plus two kilometres for speed limits below 60 kilometres per hour. Meaning you can not be fined for driving at 35 km/h in a 30 km zone and also 46 km/h in a 40 km zone.
b) 10 km/h for all speed limits from 60 km/h and above. Meaning you can now drive at 70 km in a 60 km zone, 90 km in an 80 km zone, 120 km in a 100 km zone.
The speed fines have also been Amended to reflect fines according to the kilometres exceeded.
Section 31 of Amendment Act of 2022 amends Section 170 of the Road Traffic Act of 2002 as follows;
(3) A person who fails to comply with a speed limit road traffic sign commits an offence and is liable, on conviction, if the speed limit is exceeded by-
a) less than 15 km/h above the tolerance limit, to a fine not exceeding 750 penalty units (ZMW 225). (Meaning that if you drive at 80 km/h in a 60km/h zone, your fine will be ZMW 225)
b) 15 km/h or more but less than 30 km/h above the tolerance limit, to a fine not exceeding 1000 penalty units (ZMW 300). Meaning if you drive at 90km/h in a 60 km/h zone, your fine will be ZMW 300)
c) 30km/h or more but less than 45 km/h above the tolerance unit, to a fine not exceeding 1250 penalty units (ZMW 375)
d) 45 km/h or more but less than 60 km/h above the tolerance limit, to a fine not exceeding 1500 penalty units (ZMW 450)
e) 60 km/h or more above the tolerance limit, to a fine not exceeding 3000 penalty units (ZMW 900)
